Breach of Trade Practices Act
Australian Competition & Consumer Commission (ACCC)
The ACCC is responsible for the Trade Practices Act 1974 and the Prices
Surveillance Act 1983.
The main parts of the Trade Practices Act 1974 that
deal with consumer protection are -
- unconscionable conduct (Part IVA) (click here for ACCC's Guide to unconscionable conduct)
- unfair practices; product safety and information; country of origin claims; conditions and warranties; actions against manufacturers/importers (Part V)
- product liability (Part VA)
- price exploitation in relation to the new tax system (Part VB)
The ACCC has the power to take legal action, impose fines and order compensation.
